Good to see these other clubs refusing to roll over.....I think that the feelings among the non-of support are such that it could be a PR nightmare for any club refusing to follow suit now.

Cowie Reluctant To Commit To ICT
ICT are a selling club whether we like it or not, and we will be for a long time to come. Selling players should be netting us far more in a season than we are realising at present...and that's because we are slow in sorting out contracts. If we're only offering 2 year contracts as a general rule for new players...then for those, like Cowie, who have made an immediate impact then we should be going back to them after 6 months (18 months left on contract) and dealing with contract extensions and getting them signed up for 3 year deals as a minimum. If a player isn't interested then it at least gives us 6 months to work on a deal or if we are selling so as not to lose on a free, then we have longer to look for replacements and garner interest from other clubs for the outgoing player.

Just been on MFR saying that ICT sent Dinamo a fax last night saying they have till 3pm today for Marius to agree to waive his fee or they will be sending the cash back.

I believe your right Caley100....but theirs nothing in the article to say he wants to go, just that he is keeping his options open. However, as I said on the Ian Black thread.... With any luck this is just Cowie looking to get the best offer he can from the club and they'll come to an agreement to extend his deal. Don't think my sanity could cope with watching ICT making a dogs dinner of yet another outward transfer deal before the season starts.

They published them before anyone had claimed anything! Until that point, details of the negotiations were quite rightly being conducted in private. Not the case at all. It perhaps took a day or so to hit the papers over here, but the press had been badgering Dinamo...hence the reason they put in their statement that it was to satisfy press speculation (or something to that effect).

A Verbal Agreement can be legally binding in any part of the UK, but it depends on the circumstances. The only difference is that Scotland has fewer situations where it is excluded than England. It doesn't matter which side of the border your on though as you would still need to prove the agreement was made. What I'm not entirely sure about is which "laws" would take jurisdiction in a cross border dispute, but I'd imagine that as it's an agreement between Marius and ICT then it will be Scotland, however if there's dispute between the contracts involving Dinamo and ICT then it could get more complicated and come down to European or International Laws of some kind.

Youngsters - how long is long enough
I just want to throw a little thought out there and see how it floats........ It struck me whilst reading some of the recent stuff about and by Brewster in the press that perhaps his own career has some baring on his willingness to give the younger lads a little longer than some fans might agree with. He came into professional football late after not making the grade as a youngster and had a pretty successful career playing at a decent level. This could be creating one of two situations.... 1. He's still a little bitter that he was rejected as a youngster and doesn't want to inflict that on other youths. 2. He is better placed to recognise those who might develop a little later than the pre-determined ideas that most other people have. As I said, just a thought.

With ICT claiming that no fee had been agreed or money received then Dinamo were, IMO, quite within their rights to publish the documents they did. Maybe ICT could take a leaf out of their book and publish the documents showing that Marius isn't entitled to his contractually agreed % of the Transfer Fee? Oh no, wait....they can't because it was apparently a verbal agreement!!! Verbal contracts, although legally binding, can be very difficult to prove and often rely on them having been completed, at least in part, to prove their existence to a court of law. In this case it would seem that ICT have shot themselves in the foot if such an agreement existed. If the Verbal Contract was "We will not agree to a transfer until you waive the rights to your %" (or something to that effect) then any lawyer half worth his salt would be able to stand up in a court and ask one question.....Why did ICT show acceptance of the offer by invoicing Dinamo for the agreed fee if a verbal contract existed with conditions that were a pre-requisite to them accepting any offer? Whilst ICT might feel like they've been "stitched-up" I don't actually believe they have any legal recourse which wouldn't amount to them losing even more money. If the Verbal Agreement existed and ICT never ensured it was fulfilled prior to accepting the Dinamo Offer then that's not "too trusting", that's naive and incompetent, and such people should not be handling large sums of money or making important decisions for any business belonging to someone else. Someone at ICT has fecked up and unless there's something more solid than a claim that a "Verbal Agreement" was made, then they need to get out before we lose any more. I don't believe they would have any legal recourse and paying solicitors would simply be a waste of money. The longer this goes on, the more we risk losing IMO. I think calls to "Sack the Board" are a little out of order.....some of those involved have done good things for ICT in the past and despite a catalogue of feck ups in the last couple of years we should show them a little respect and give them the opportunity to resign first.

And another thing.....regardless of whether or not you accept that this verbal agreement between club and player exists....if ICT are doing business for deals in the hundreds of thousands and they are relying on "verbal agreements" then it only serves to prove what many have been saying about their incompetence.

Sorry Alex, but that's BS. Marius has/had a contract with ICT and that can only be terminated by mutual consent. So whilst ICT might have found a club willing to pay more, if the player doesn't want to go there or can't agree personal terms then he can't, and shouldn't, be blackmailed as a result. ICT have/had a choice....if the didn't think the Dinamo offer was high enough and left them with an unsatisfactory amount after ICT had met it's liabilities in terminating the contract with Marius, then they did not have to accept it. Would you accept your employer terminating your contract early and sending you off to somewhere you didn't want to go on terms you didn't agree with? Didn't think so, and I fail to see why it should be any different in this case.

Was just on STV, ICT have the money but won't sign release papers till Marius signs a Waiver. Also a Statement from an Adrian someone or other at Dinamo saying they have reported ICT to FIFA and UEFA for not releasing the player and that they are confident FIFA will find in their favour.
