Inverness Caledonian Thistle left reeling after Marius Niculae wins fee dispute

Fifa says the newly promoted Scottish Premier League side must pay their former striker money due from his transfer to Dynamo Bucharest in 2008. Inverness Caledonian Thistle have been left reeling from the harsh financial blow after Fifa insisted yesterday that they must pay their former striker, Marius Niculae, ?142,500 (about ?133,000).

Niculae reported the Highland club, who suffered a costly relegation to the Irn-Bru first division in May, to world football?s governing body immediately after his transfer to Dynamo Bucharest in July 2008. He claimed he was due to receive 30 per cent of the transfer fee for the ?475,000 move back to his native Romania after a season in Scotland, as was stipulated in his contract.

Inverness had initially refused to release paperwork to allow Niculae?s transfer to be completed until the Romania international waived both his sell-on entitlement and that for the second half of a ?200,000 signing-on fee. Dynamo, on receipt of an invoice, promptly paid the Scottish side the agreed transfer figure and published documents on their website showing this monetary transfer had been made; a move which led to his formal release from Scotland.

Niculae was still of a mind to reclaim both sets of payments due to him; Fifa?s dispute resolution chamber has agreed that the sell-on figure was indeed payable.

Inverness decided to take the issue to the Court of Arbitration for Sport, a move that has subsequently cost them another ?20,000. ?The club?s view was that it was a risk worth taking as we felt that the player instigated his own transfer by requesting a transfer and thereafter arranging the same,? a statement from the club said.

The evidence from around the time of Niculae?s exit, though contradicted the very basis of Inverness?s case. There was also clear evidence of a written transfer request presented by Niculae's legal team.

The civil action between Niculae and Inverness has apparently been completed by an "undisclosed out of court payment".

Invisible ink would be more appropriate.
